Why The Interquartile Range, Not The Full Range

Using the full spread of comparables lets a single unusually strong or weak comparable distort the benchmark. The interquartile range trims the top and bottom quarters, a more defensible statistical range that CRA and most tax administrations reference in practice.

What Contemporaneous Documentation Actually Buys You

Under Section 247 of Canada's Income Tax Act, a transfer pricing adjustment on a transaction lacking contemporaneous documentation triggers an automatic 10% penalty on the adjustment, regardless of whether the taxpayer would otherwise have had a reasonable position. Documentation prepared by the filing deadline, not after CRA opens an audit, is what "contemporaneous" actually requires.

When To Actually Use This Model

  • Teaching the Transactional Net Margin Method (TNMM) and interquartile range concept in an international tax course.
  • Screening a related-party transaction's documented margin against a comparable set before a full benchmarking study is commissioned.
  • Prioritizing which intercompany transactions most need formal transfer pricing documentation given size and tax rate differential.

Key Assumptions & Limitations

  • A real benchmarking study screens dozens of potential comparables down to a handful on functional, industry and size comparability, not just their margins.
  • This tool uses operating margin (TNMM) only, other transfer pricing methods (CUP, cost-plus, resale price, profit split) apply to different transaction types and won't be captured here.
  • The BEPS risk score is illustrative and not a substitute for a real risk assessment against CRA's actual audit selection criteria.
